@10 (and I believe others have) suggested that Fairey is parodying the original content of the posters he's ripping off. That's a wrong (and, sorry, but stupid) reading of his work. Here's a quote for the catalog of his show...

It's a great infographic; my only wish is that it didn't convey that the struggle is somehow over now that we have a black president. (I'm sure it's unintended, but as a timeline it suggests some finality.) Here's to appreciating...

Dharma is either a patent liar or totally ignorant of how trials are conducted... the trial he alludes to was a comparison of sham acupuncture vs acupuncture and paracetamol for back pain in patients who had absolutely no relief using medicine and its technology. $450 sounds like a rip-off to me, especially when they are sold for less than $300 at the manufacturer's site. If all you need is a 1 to 1 duplicator, I would suggest this, which is only $320. I have one and it works just as good....

@#57: Totally. I think that day in my copyright class we were talking about ways that judges sneak in sweat-of-the-brow analysis in order to let people off the hook. The case I was thinking of at the time was Kieselstein-Cord v. Accessories by Pearl, Inc. 632 F.2d 989 (1980), where the court used an artist's travels, research and awards to determine that a belt buckle rose "to the level of creative art." Of course, that case was about separability, not fair use, whoops! I don't think we'd eve read Feist at that point. Law student mistake, thanks for pointing it...

re#27: I just watched it (the film Strange Culture)as well. I was jaw-droppingly appalled at the Kafkaesque nightmare that Prof. Kurtz has been forced to endure. Not totally shocked, mind you, for as a child of the turbulent 50's in the deep south, I have seen this sort of thing happen in the USA before. It scares me to no end to witness a so-called 'righteously sanctioned' part of our society (a political party) that has utilized Fear so well so that it has seized control of far too many otherwise perfectly decent people. They (that political den of anakes)...
